The ScalynTerms of Service

By accessing or using Scalyn, you agree to be bound by these Terms and any policies or guidelines expressly incorporated by reference. If you use the service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

If you do not agree, do not access or use the service.

You must be legally capable of entering into a binding agreement to use the service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

• Provide accurate and current account information.
• Keep your credentials secure.
• Notify us promptly of any unauthorized access or suspected breach.
• Use the service in compliance with applicable law.

Scalyn provides software and related services that may include analytics, workflow automation, collaboration tools, integrations, APIs, AI-assisted features, and related functionality that we make available from time to time.

Certain features may be subject to product-specific terms, usage limits, or documentation. We may update, improve, replace, or discontinue parts of the service as needed.

Paid plans may be offered on a subscription basis or under a separate order form. Unless otherwise stated in writing, fees are quoted in U.S. dollars and are non-refundable except where required by law.

• You authorize us to charge all applicable fees and taxes to your payment method.
• Subscriptions may renew automatically unless canceled in accordance with plan terms.
• We may suspend paid features for overdue amounts after reasonable notice.

You may use the service only in compliance with these Terms, applicable law, and any documentation or usage policies we provide.

• Reverse engineer, probe, or interfere with the platform or underlying systems.
• Upload malware, harmful code, or content designed to disrupt service integrity.
• Use the service to violate law, infringe rights, or misappropriate confidential information.
• Automate abusive access, scrape data at scale, or bypass usage restrictions or rate limits.
• Generate or distribute deceptive, fraudulent, harassing, or harmful content through the service.
• Use the service to build or benchmark a competing product without our prior written consent.

The service, including its software, interfaces, design, trademarks, logos, documentation, and underlying technology, is owned by Postly Technologies, Inc. or its licensors and is protected by intellectual property and other applicable laws.

You retain ownership of content, data, files, prompts, inputs, and other materials you submit or upload through the service (“User Content”). You grant us a limited, non-exclusive license to host, process, transmit, and display User Content solely to operate, secure, maintain, improve, and provide the service.

You represent that you have all rights necessary to provide User Content and that your use of the service does not violate law or third-party rights.

Our collection and use of personal information is described in our Privacy Policy. We use commercially reasonable safeguards designed to protect the service and customer data, but no system is completely secure.

The service may interoperate with third-party products, websites, APIs, or integrations. Your use of third-party services is governed by their own terms and privacy practices, not ours.

Certain features may use artificial intelligence or machine learning to generate suggestions, summaries, recommendations, or other outputs. AI outputs may be incomplete, inaccurate, or unsuitable for a particular use case and should be reviewed by a human before you rely on them.

We may update, improve, change, or discontinue all or part of the service at any time. We do not guarantee uninterrupted availability or that every feature will remain available forever.

You may stop using the service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, failed to pay fees when due, or if required by law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTLY TECHNOLOGIES, INC. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTLY TECHNOLOGIES, INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You will defend, indemnify, and hold harmless Postly Technologies, Inc., its affiliates, and their respective officers, directors, employees, and agents from and against claims, liabilities, damages, losses, costs, and expenses arising out of or relating to your User Content, your misuse of the service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, excluding its conflict of laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Delaware.
